18 U.S.C. §2257 Record Keeping Requirements Compliance Statement

The operator of Cake.ski is not the producer (whether primary or secondary as defined in
18 U.S.C. § 2257) of any of the content found on Cake.ski. The operator’s activities, with
respect to such content, are limited to the transmission, storage, retrieval, hosting and/or
formatting of depictions posted by third party users, on areas of the website under the
user’s control.
Please direct any request you may have regarding §2257 records in relation to any content
found on Cake.ski, directly to the respective uploader, amateur, producer, studio or account
holder of the content (“Uploaders”).
For further assistance in communicating with the Uploaders, or any questions regarding this
notice, please contact Cake.ski’s compliance department at
compliance@cake.ski.
Compliance procedures
Cake.ski abides by the following compliance procedures regarding uploaded content:
- Content may only be uploaded from a registered Cake.ski account. Anonymous visitors
cannot upload. All Uploaders must be over eighteen (18) years of age, or the age of
majority required by their State, jurisdiction or Country if more than 18 years old.
- Prior to every upload, Cake.ski requires the Uploader to certify that:
- all individuals appearing in the content are over the age of 18 years old (or the
minimum age required to appear in such content by their State, jurisdiction or Country
if more than 18 years old); that they freely consented to appear in the content at the
time of its production and agree to its upload on Cake.ski;
- as producer of said content, the Uploader certifies being compliant with record
keeping requirements under 18 U.S.C. § 2257 for all content uploaded on Cake.ski, and
agrees to deliver such documentation promptly upon request;
- the uploaded content does not violate Cake.ski’s
Terms of Service or any of its related policies, namely but without
limitation its prohibition on child sexual abuse material or non-consensual
content.
- This certification is enforced by the Service at the time of upload and is recorded
against the submission, together with the originating IP address and timestamp, as an
audit trail.
- Uploaded content is placed in a moderation queue and reviewed before it is published.
- All uploads are screened against a perceptual-hash denylist of known child sexual abuse
material. Any match is blocked, the responsible account is permanently banned, the
evidence is preserved, and the matter is reported to the National Center for Missing &
Exploited Children (NCMEC).
- Any visitor — including visitors without an account — may report any item on the Service.
Content reported as depicting a minor, or as published without the consent of a person
appearing in it, is treated as a priority and removed.
